THE RESERVATION CONTRACT
Once we have found your dream property or commercial investment, the reservation contract will be drawn up.
The reservation contract is a contract in which the buying party and the selling party commit themselves in the buying and selling process.
In this contract, the agreement between the parties is formalised. It has to mention the sale price, the agreed deadline for the signing of the sales contract.
The amount to be paid corresponds to a payment of 3,000 or 5,000 euros, depending on the sale price of the property.
If applicable, the reservation contract may mention specific clauses depending on the situation of the parties or subject the continuation of the process to a resolutory clause. For example, the obtaining of a mortgage or the absence of town planning infringements.
THE CONTRACT OF SALE
Between the signing of the contract and the signing of the purchase contract, all the research concerning the property is carried out.
This is an important step, as it involves checking that the property has no town planning infringements or any other irregularities and that there are no outstanding charges or debts.
This contract contains at least: the details of the buyer and seller, the price, the specifications of the property (by deed and/or nota simple).
The amount paid with the reservation contract and the amount of 10% to formalise this new contract is also notified.
THE NOTARIAL DEED
The public deed is the last legal step, in which the sale is ratified before a notary and which offers legal certainty. It has powerful and regulated effects.
All notaries in Spain charge the same for the same service (they can give you a 10% discount).
Spanish notary fees are, after Portugal, the lowest in Europe.
After signing the title deeds, the new owner has the keys to his new property.
TAXES
The purchase of a property obviously involves the payment of taxes in addition to the purchase price.
Used property in the Valencian Community: Transfer Tax (Impuesto sobre Transmisiones Patrimoniales, ITP)
In general, this tax is 10%.
Spanish residents under 35 years of age have a reduced rate in the case of the purchase of their first main residence. In this case, the tax is 8%.
New homes: Value Added Tax (VAT)
The sale of new homes is subject to Value Added Tax (VAT).
In general, this tax is 10%.
Purchase with a mortgage: Stamp duty (AJD)
The AJD is levied on the legal documents associated with the purchase of a property when it is sold by means of a mortgage.
PUBLIC SERVICES
Once the owner of the property has changed, the change of ownership of the utility contracts in your name can be acted upon. As well as water, electricity and all others.
THE LAND REGISTER
Once the purchase of the property has been signed at the notary's office, it is registered in the land register.
This public institution is responsible for creating title deeds for real estate in order to promote legal certainty.
The cost depends on the value of the property, but is normally between 0.1% and 0.25% of the property price.
